This Privacy Policy explains how Redhead Homes d/b/a Redhead Luxury Properties, LLC (“Redhead Luxury Properties”, “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with our website at redheadluxuryproperties.com (the “Website”), our telephone number (866) 576-1478 (the “Number”), and the real estate services we provide (together, the “Services”).
This Policy applies to information collected through the Website (including contact forms, chat widgets, and appointment scheduling tools), through calls and text messages to or from the Number, and through our customer relationship management (CRM) and marketing platform.
This Policy should be read together with our Terms and Conditions, which governs your use of the Website generally.
By visiting the Website, calling or texting the Number, submitting a form, or otherwise providing information to us, you acknowledge that you have read and understood this Privacy Policy.
2. Information We Collect
2.1 Information You Provide Directly

Contact information: your name, telephone number, email address, and mailing address.

Property and transaction information: information you choose to provide about properties you own, wish to buy, sell, lease, or manage, including showing requests, budget, and preferences.

Communication content: the content of forms, chat messages, emails, text messages, WhatsApp messages, voicemails, and call notes.

Consent records: the date, time, method, and source of your SMS opt-in or opt-out.
2.2 Information Collected Automatically
When you visit the Website, we and our service providers automatically collect certain information, including:

IP address and approximate geographic location;

Browser type and version, device type, and operating system;

Pages viewed, time spent on pages, referring and exit pages, and click activity; and

Date and time of your visit.
2.3 Analytics and Tag Management Tools
We use Google Analytics 4 (“GA4”) to understand how visitors use the Website, deployed through Google Tag Manager (“GTM”), a tag management system that allows us to configure and manage the tags and scripts running on the Website. GA4 and GTM use cookies and similar technologies to collect information such as pages viewed, session duration, device and browser information, and general geographic location. Through GTM we also run the Meta Pixel (Meta Platforms, Inc.), which measures the performance of our advertising and lets us show our ads to people who have visited the Website, and Microsoft Clarity, which records how visitors move around and interact with pages, such as clicks, scrolling, and how a page appears on screen, to help us improve the Website. Our GoHighLevel site tracking script also records visits to the Website so that we can connect them to inquiries. See Section 4 (Cookies and Tracking Technologies) below for more detail and your choices.
2.4 Our CRM and Marketing Platform (GoHighLevel)
We use GoHighLevel (which sends email and text messages under the name “LeadConnector”) as our customer relationship management and marketing automation platform. When you submit a form, book an appointment, use a chat widget on the Website, or communicate with us by phone, text, or email, that information is stored and processed within our GoHighLevel account, including:

Form submissions and appointment or calendar bookings;

Chat widget conversations;

Email and text message content and engagement data, such as opens, clicks, replies, and delivery status; and

Notes, tags, and pipeline or status information we maintain internally about your inquiry or transaction.
GoHighLevel acts as a data processor on our behalf and is contractually restricted from using your information for its own marketing purposes.

3. How We Use Your Information
We use the information described above to:

Respond to your calls, texts, form submissions, and other inquiries;

Schedule and confirm property showings, appointments, inspections, and photography sessions;

Provide real estate services, including buyer’s agency, seller representation, leasing, and property management services;

Operate, maintain, secure, and improve the Website and our internal CRM records;

Analyze Website traffic and usage patterns using GA4 and GTM to improve our content and user experience;

Send transactional and informational messages, such as appointment reminders, transaction and lease updates, and maintenance notifications;

Send marketing or promotional messages about properties and services, only if you have expressly opted in to receive them;

Comply with legal, regulatory, and real estate licensing obligations.
4. Cookies and Tracking Technologies
The Website uses cookies and similar technologies, including those associated with Google Tag Manager, Google Analytics 4, the Meta Pixel, and Microsoft Clarity, our GoHighLevel site tracking, and cookies set by our GoHighLevel-powered contact forms, chat widgets, and scheduling tools. Categories of cookies used on the Website include:

Necessary cookies: the technical cookies and browser storage that run the Website. They keep it secure and working, remember your cookie choice, and let features you use, such as contact forms, scheduling tools, and messaging tools (including those provided by our GoHighLevel/LeadConnector platform), do their job. These do not depend on your cookie choices and cannot be switched off on the Website.

Analytics cookies: GA4 and Microsoft Clarity, both deployed through GTM, show us how visitors use the Website so we can improve it. GA4 collects usage data such as pages viewed and time spent. Clarity records how visitors move around and interact with pages, such as clicks, scrolling, and how a page appears on screen. Google processes this data in accordance with the Google Privacy Policy (policies.google.com/privacy) and Google’s page on “How Google uses information from sites or apps that use our services” (policies.google.com/technologies/partner-sites). Microsoft processes Clarity data in accordance with the Microsoft Privacy Statement (privacy.microsoft.com/privacystatement).

Marketing cookies: the Meta Pixel, deployed through GTM, helps us measure the performance of our advertising and show our ads to people who have visited the Website. Meta processes this data in accordance with its own privacy policy (facebook.com/privacy/policy). Where we use Google’s advertising features, Google may also use data from the Website, collected through GTM and GA4, to measure advertising results and to show personalized ads. You can manage how Google personalizes ads at adssettings.google.com. Our GoHighLevel site tracking also records visits to the Website so that we can connect them to inquiries.
Your choices. The Website shows a cookie notice that lets you switch analytics cookies and marketing cookies on or off separately. Necessary cookies are always on. The notice works as follows:

If you are visiting from a place where privacy law expects your consent first, analytics and marketing cookies do not load unless you allow them. This includes the European Economic Area (“EEA”), the United Kingdom, Switzerland, Quebec, Brazil, and a number of other countries in Latin America, Asia, the Middle East, and Africa. It also applies if we cannot tell where you are. You can select “Accept all,” or “Manage preferences” to allow only one category. If you select “Reject all,” or do not answer, they stay off.

If you are visiting from anywhere else, including the rest of the United States and Canada, analytics and marketing cookies load when you arrive and the notice lets you opt out. You can select “Opt out” to turn both off, or “Manage preferences” to turn off one and keep the other. If your browser sends a Global Privacy Control signal, we treat it as an opt out of marketing cookies and leave them off. We remember your choice.
In both cases you can change your choices at any time using the “Cookie choices” link in the footer of the Website (shown as “Your Privacy Choices” to visitors in the United States) or the cookie button at the bottom left of each page. We remember your choices in your browser’s local storage, and we ask again if this Policy changes in a way that affects these tools.
To decide which of these applies, the Website checks your approximate location, meaning your country and, where the law differs, your state or province, through our hosting and security provider, Cloudflare, when you visit. We keep only the result, in your browser, for the length of your visit.
You can also control or delete cookies directly through your browser settings, and Google offers a browser add-on that allows you to opt out of Google Analytics data collection, available at tools.google.com/dlpage/gaoptout. Please note that disabling cookies may affect the functionality of forms, chat widgets, and scheduling tools on the Website.

5. SMS / Text Messaging Program
Consent. We send text messages only to individuals who have provided consent — for example, by texting us first, submitting a form that includes an SMS consent checkbox, or verbally agreeing to receive texts. Consent to receive text messages is not a condition of purchasing, selling, or renting any property or of using any of our services.
A2P 10DLC. Our text messaging program is registered under the wireless industry’s Application-to-Person (A2P) 10DLC framework, which governs business text messaging sent over standard long code and toll-free numbers in the United States. Registration helps ensure reliable message delivery and compliance with carrier requirements.
Message types. Messages may include responses to inquiries, appointment scheduling and reminders, transaction and lease updates, maintenance and property notifications, customer care responses, and, only if you have opted in, new listing alerts and market updates.
Message frequency. Message frequency varies based on your interactions with us and the status of your real estate matter.
Costs. Message and data rates may apply, depending on your mobile carrier and plan. Redhead Luxury Properties does not charge for Program messages. Any carrier-imposed surcharges associated with A2P 10DLC messaging are billed by, and payable to, your mobile carrier.
Opting out. You may opt out at any time by replying STOP to any message from (866) 576-1478. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT — these are the keywords recognized by our messaging platform. You will receive one final message confirming your opt-out, and no further messages will be sent unless you opt in again. To rejoin, text START to (866) 576-1478.

Carrier disclaimer. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed.
No sharing of opt-in data.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or rented to any third parties, except service providers (such as our messaging platform, GoHighLevel/LeadConnector) who help us operate the Program. All other categories of information described in this Policy exclude text messaging originator opt-in data and consent.
6. How We Share Your Information
We do not sell your personal information. We may share information only in the following limited circumstances:

Service providers: with vendors who help us operate the Services, including GoHighLevel/LeadConnector (CRM, forms, scheduling, and SMS/email delivery), Google (Analytics and Tag Manager), Meta (WhatsApp and advertising measurement), Microsoft (Clarity), and our website hosting and development provider, solely to perform services on our behalf and subject to confidentiality obligations. These providers are not permitted to use your information for their own marketing.

Transaction participants: with parties directly involved in a real estate transaction or tenancy you are part of (such as lenders, title companies, inspectors, photographers, property owners, or cooperating brokers), only as needed to provide the services you requested, and never including your SMS opt-in data or consent.

Legal requirements: when required by law, subpoena, court order, or regulatory or licensing authority, or to protect our rights, property, or safety or that of others.

Business transfers: in connection with a merger, sale, or transfer of all or part of our business, subject to this Privacy Policy.
7. Data Retention
We retain personal information collected through the Services for as long as necessary to operate our CRM, maintain a complete record of your relationship with us, and meet legal, tax, contractual, and real estate licensing record-keeping requirements. As a matter of routine business practice, we do not delete or anonymize personal information from our systems.
Where applicable law gives you the right to request deletion of your personal information — including the rights described in Section 9 (Your Privacy Rights) and, for individuals in Portugal or the European Union, Section 12 — we will evaluate and respond to verified requests as required by that law, subject to any applicable exceptions (for example, information we are required or permitted to keep for legal, tax, contractual, or licensing purposes).
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your Privacy Rights
Depending on where you live, including under the Colorado Privacy Act and similar laws in other states, you may have the right to:

Request deletion of your personal information;

Obtain a copy of your information in a portable format; and

Opt out of targeted advertising, the sale of personal data, or certain profiling.
To exercise any of these rights, contact us using the information in Section 14. We will verify your identity before responding and will respond within the time required by law. If we deny your request, you may appeal by contacting us with the subject line “Privacy Appeal.” We will not discriminate against you for exercising your rights.
10. Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is not yet a common industry standard for recognizing these signals, our Website does not currently respond to them. You can still manage cookies and analytics as described in Section 4.
11. Children’s Privacy
The Services are not directed to children under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.
12. Portugal, the European Union, and Other International Visitors
Cindy Marlowe provides relocation-related real estate services to individuals considering or pursuing a move to Portugal. Most of these individuals are located in the United States at the time they interact with us, and this section does not suggest that the GDPR broadly applies to our business. This section applies only to the extent you are located in Portugal, elsewhere in the European Economic Area (“EEA”), or the United Kingdom at the time we process your personal information — for example, if you have already relocated to Portugal and continue to communicate with us from there.
Legal basis for processing. Where the EU General Data Protection Regulation (“GDPR”) applies to our processing of your personal information, we rely on one or more of the following legal bases: your consent (for example, when you opt in to text messages or marketing emails); the necessity of processing to take steps at your request before entering into a contract, or to perform a contract, with you (for example, arranging a property showing); our legitimate interests in operating and marketing our real estate services, provided those interests are not outweighed by your rights; and compliance with a legal obligation.
Your rights. In addition to the rights described in Section 9, if the GDPR applies to you, you have the right to access your personal information; correct or update it; request its erasure; restrict or object to certain processing, including direct marketing; receive a portable copy of information you provided to us; and withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out before you withdrew it. Notwithstanding the general retention practice described in Section 7, if your erasure request is granted under the GDPR, we will delete the applicable personal information rather than retain it.
International transfers. We are based in the United States, and personal information we collect is generally stored and processed in the United States by us and by our service providers, including GoHighLevel/LeadConnector and Google. Data protection laws in the United States may differ from those in Portugal or the EEA. Where required, we rely on appropriate safeguards, such as standard contractual clauses, for these transfers.
Supervisory authority. If you are located in Portugal, you may lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), Portugal’s data protection supervisory authority, or with the supervisory authority in your own place of residence.
Cookies. As noted in Section 4, if you are located in the EEA, the United Kingdom, Switzerland, or another place where consent is required (see Section 4), or if we cannot tell where you are, analytics cookies (GA4 and Microsoft Clarity) and marketing cookies (the Meta Pixel and our GoHighLevel site tracking) load only if you allow them on the cookie notice. You can allow one category without the other. You can withdraw your consent at any time using the “Cookie choices” link in the footer of the Website or the cookie button at the bottom left of each page, without affecting the lawfulness of processing carried out before you withdrew it.
Real estate licensing in Portugal. Where a member of our team is in the process of obtaining real estate licensure in Portugal, that status — including any required disclosure and reference to the licensed network under which services are provided — will appear on the specific page or communication relating to services in Portugal, in accordance with Portuguese real estate regulations.
If you access the Website from outside the United States generally, your information may be processed in the United States, where data protection laws may differ from those of your home country.

The Website may contain links to third-party websites, including MLS/IDX listing providers and social media platforms. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be indicated by a revised “Last Updated” date. Material changes will be communicated as required by law. Continued use of the Services after changes take effect means you accept the updated Policy.
