By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Website.

2. Description of the Website and Services

The Website provides information about Redhead Luxury Properties, including real estate listings, market content, and ways to contact us regarding buying, selling, leasing, or managing property. The Website also allows you to submit inquiries, schedule appointments, and opt in to receive text messages and email communications from us.

3. Eligibility

You must be at least 18 years old to use the Website and Services or to enroll in our text messaging program. By using the Website, you represent that you meet this requirement and, if enrolling a mobile number for texts, that you are the account holder for that number or have the account holder’s permission.

4. Real Estate Listing Information

Listing information displayed on the Website, including property details, pricing, availability, and photographs, may be provided in whole or in part through Multiple Listing Service (MLS) or Internet Data Exchange (IDX) feeds maintained by third parties. While we make reasonable efforts to display accurate and current information, we do not guarantee the accuracy, completeness, or timeliness of any listing information, and all information should be independently verified before you rely on it. Listings are subject to prior sale, change, or withdrawal without notice.

5. Fair Housing Statement

Where a member of our team is in the process of obtaining real estate licensure in a jurisdiction, that status — and any required disclosures — will be identified on the relevant page or communication concerning that jurisdiction.

This includes our services in Portugal: until any required Portuguese real estate licensing is complete, marketing and communications relating to Portugal will disclose the licensing status of the team member involved and reference the licensed network under which those services are provided, in accordance with Portuguese real estate regulations.

• Scrape, data-mine, or use automated means to extract content, listing data, or contact information from the Website without our prior written consent;

• Attempt to gain unauthorized access to the Website, our CRM, or related systems;

• Interfere with or disrupt the operation of the Website, including any forms, chat, or scheduling tools; or

• Impersonate any person or misrepresent your affiliation with any person or entity.

8. Forms, Chat, and Scheduling Tools

Contact forms, chat widgets, and appointment scheduling tools on the Website are powered by GoHighLevel (which sends messages under the name “LeadConnector”), our customer relationship management and marketing automation platform. Information you submit through these tools is collected and processed as described in our Privacy Policy.

9. SMS / Text Messaging Program (A2P 10DLC)

Program description. By opting in, you agree to receive text messages (SMS/MMS) from the toll-free number (866) 576-1478 related to our real estate services, which may include responses to inquiries, appointment scheduling and reminders, updates on buyer, seller, rental, or property management matters, transaction status updates, tenant and landlord communications, and, only if you have separately opted in, new listing alerts and market updates.

How you opt in. You may opt in by checking the SMS consent box on a Website form, texting a keyword such as START or JOIN to (866) 576-1478, or giving verbal or written consent to a Redhead Luxury Properties representative. Consent to receive text messages is not a condition of purchasing, selling, or renting any property or of using any of our services.

A2P 10DLC registration. This Program is registered under the wireless industry’s Application-to-Person (A2P) 10DLC framework governing business text messaging in the United States. Message delivery is subject to the policies of participating wireless carriers.

Message frequency. Message frequency varies based on your interactions with us and the status of your real estate matter.

Cost. Message and data rates may apply. Charges are billed by and payable to your mobile carrier. Redhead Luxury Properties does not charge for Program messages. Contact your carrier for details about your text and data plan.

How to opt out. You can cancel at any time by texting STOP to (866) 576-1478. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT — these are the keywords recognized by our messaging platform. After you send an opt-out request, you will receive one final confirmation message, and no further messages will be sent unless you opt in again. To rejoin, text START to (866) 576-1478.

Supported carriers and liability. The Program is available on most major U.S. wireless carriers. Mobile carriers are not liable for delayed or undelivered messages. Redhead Luxury Properties is not responsible for delays or failures in delivery caused by your carrier, device, or network coverage.

Eligibility. You must be at least 18 years old and the account holder, or have the account holder’s permission, for the mobile number you enroll. You agree to notify us promptly if you change or deactivate your mobile number.

Privacy. Information collected through the Program is used only to deliver the Program and provide our services, as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers (such as GoHighLevel/LeadConnector) who help us operate the Program.

Message content. Text messages are for informational and convenience purposes only. They do not constitute a binding offer, contract, legal advice, or financial advice. Please do not send sensitive personal information (such as Social Security numbers, bank account numbers, or passwords) by text message.

10. Testimonials and Reviews

Any testimonials, reviews, or endorsements displayed on the Website reflect the individual experiences of the persons named and are not a guarantee of future results. Testimonials are used with permission and are not intended to suggest a similar outcome for any other individual.

11. Intellectual Property

These third parties operate under their own terms and privacy policies, and we are not responsible for their content or practices. Your use of the Website constitutes your acknowledgment that these tools are in use, as further described in our Privacy Policy.

15. Indemnification

You agree to indemnify and hold harmless Redhead Luxury Properties and its owners, agents, and service providers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Website or Services.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.

If you access or use the Website or Services from Portugal or another jurisdiction with mandatory local consumer protection, data protection, or real estate regulatory requirements, those mandatory provisions will apply to the extent required by that jurisdiction’s law, notwithstanding the Colorado choice of law above.
